Notice on the need for coal production and transportation in 2012
Provinces, autonomous regions, and municipalities, the Development and Reform Commission, the Economic and Trade Commission (Economic Commission, Economic and Information Committee, the Industry and Information Technology Committee), the Ministry of Industry and Information, the Coal Department (bureau, office), coal, electricity, fertilizer industry associations, related companies:
Since the beginning of this year, the nation’s coal production and transportation have maintained a momentum of rapid growth, and supply has generally remained stable. With the joint efforts of all parties, it has overcome the unfavorable factors such as drought and rain in the south, significant reduction in hydropower, and tight electric coal in some regions, which ensured the stable and rapid development of the national economy. It is expected that the supply and demand of coal will remain basically balanced in 2012, but due to a variety of unfavorable factors, there will also be an imbalance between electricity supply and demand in some areas and at certain times. In order to ensure the stable supply of coal in key industries, the following is the relevant notice regarding the convergence of coal production, transportation, and transportation across provinces in 2012:
 First, strengthen guidance on macroeconomic regulation and give full play to the role of the market mechanism. (1) Our committee works with relevant departments and units such as railways, transportation, etc., in accordance with the requirements of the relevant documents of the State Council, do a good job of comprehensive balance of the total amount of coal production, transportation and demand, and study and formulate the 2012 cross. The principle of coal production and transportation between provinces and districts needs to be brought into play. It proposes a framework plan for transportation capacity allocation and a coal price policy to guide the nation's development of production, transportation and demand.
(2) The supply and demand sides must adhere to market-oriented, autonomous convergence, and negotiation. All parties concerned must strictly implement the policy of convergence of production, transportation and transportation, and must not intervene in the normal connection of enterprises for any reason.
(3) Encourage both sides of the coal supply and demand to sign mid-to-long-term contracts, which will lay a good foundation for the establishment of long-term stable supply and demand relations. Accelerate the establishment of a coal market system with the national coal trading center as the main body, supplemented by the regional market, and network technology as the platform, which is conducive to the government’s macroeconomic regulation and control and the free trading of market entities.
 2. Adhere to the principle of independent supply and demand, and sign contracts for purchase and sale in accordance with the law. (1) All supply and demand enterprises engaged in coal production and business activities according to law may participate in the connection. Support coal mines and end-consumer companies to directly sign contracts and reduce intermediate links. It is strictly forbidden that coal mines with incomplete licenses and illegally operating companies and users will participate in the connection.
(2) The supply and demand sides shall sign a coal purchase and sales contract with complete and standardized content and legal validity according to the relevant provisions of the Contract Law. The product quality, price and liability for breach of contract shall be specified in the contract. The number of contracts shall be determined in accordance with the 2012 inter-provincial coal transportation capacity allocation directive framework. In principle, except for the adjustment of the framework, the number of other key contract coals will remain unchanged from the previous year, and And the power plant remained relatively stable. It is forbidden to enter into false contracts that are separated from the actual production and demand, and will be seriously dealt with once detected.
(3) The supply and demand sides should strengthen cooperation and speed up the connection progress in accordance with the principle of high efficiency and economy, and complete the signing of the contract within 15 days after the issuance of this notice. All parties concerned shall not interfere with or delay the signing of the contract for any reason.
(4) All contracts signed by supply and demand parties must be registered in the China Coal Market Network () coal network trading system. The Coal Industry Association is responsible for coordinating related information services such as information collection and contract collection.
 Third, the implementation of price control policies to stabilize the price of coal for power generation
Coal is an important basic energy source, and a significant increase in coal prices has a greater impact on power generation companies. To this end, all parties concerned should further increase their understanding of the importance of the regulation of coal prices, and earnestly implement the “Notice of the National Development and Reform Commission on Strengthening the Control of Coal Prices for Power Generation†(Dianfa Electric [2011] No. 299). Self-discipline to stabilize coal prices for power generation.
 IV. Optimize the allocation of coal transportation capacity and guarantee the demand for key coal (A) After the signing of the key contract between the supply and demand sides, the parties involved in coal production and transportation should actively strengthen communication and cooperate with each other to implement the transportation capacity. The Ministry of Railways and the Ministry of Transport instructed the relevant railway bureaus and port and shipping companies to do a good job in the allocation of transportation capacity, and based on the framework opinions, determine the capacity allocation based on the actual completion conditions and newly added capabilities.
(2) For coal supply and sales contracts signed by supply and demand enterprises with complete and standardized contents, all railway administrations must confirm their capacity in a timely manner, and must confirm the promised transportation by the port concerned through water transport, guarantee quality, quantity, and complete the convergence of transportation capacity on time.
(3) The allocation of coal transportation capacity should reflect the requirements of the state's industrial policies; the large and medium-sized enterprises that have done a good job in energy conservation and emission reduction, have a high rate of contract fulfillment, and have good conditions for loading and unloading vehicles are inclined. The focus will be on protecting coal, fertilizers, residents' lives, and national coal emergency reserve. For medium and long-term contracts signed by coal supply and demand enterprises, priority shall be given to the transportation capacity. Carry out nuclear reduction for enterprises with very low cashing rates for key contracts.
V. Strengthen supervision, fulfill responsibilities, and fully complete all tasks for connection. (1) China Coal Industry Association and the State Grid Trading Center. According to the actual conditions of coal production, capacity allocation, and power company requirements, the railways and ports that are signed by the supply and demand sides The key coal coal contracts for enterprises to allocate capacity were verified and submitted to the Committee, the Ministry of Railways and the Ministry of Transport.
(II) The Committee and the Ministry of Railways and the Ministry of Transport shall strengthen the supervision and guidance of the linking work, and make necessary adjustments to those that are contrary to the convergence policy and may have a significant impact on the stable supply of coal.
(3) All parties involved in production and transportation must strictly perform the contract and ensure that they are honored. The Committee will, together with relevant departments and units, supervise and inspect the implementation of key coal-fired coal contracts in accordance with relevant supervisory functions.
All relevant localities, departments, industry associations, and production- and transportation-needed enterprises must enhance their awareness of the overall situation and their sense of responsibility, strengthen coordination, and cooperate closely with each other in an effort to ensure that coal production, transportation, and transportation need to be coordinated in 2012.
